    Partition Actions

    Do you own or have an interest in real property with someone you no longer agree or wish to own with? In an action for Partition, even if your name is not on the deed, you may be entitled to your portion of the equity in a forced sale. Sometimes, you may even have the right to buy your partner’s share out and own the entire parcel yourself! Every situation is different, but if you have been ousted, demand an accounting for contribution or reallocating ownership share, or simply no longer wish to co-own, contact me at your earliest convenience.

    Inheritance and Estate Taxes

    New Jersey abolished the estate, or “death” tax, in 2018, but that does not mean an estate nor beneficiaries are subject to a tax. In fact, decedents predeceasing 2018 may still have to file an estate tax return. Beneficiaries who are not Class “A” also require the personal representative to file an Inheritance Tax Return with the Division of Taxation and the requisite taxes paid. If you are an estate fiduciary or beneficiary and wish to ensure the Division of Taxation will file the waivers to release all estate assets and lift its lien on the estate, contact me at your earliest convenience.

    Guardianship

    If a “vulnerable adult” or other person has “incapacity,” it may be too late to have estate planning documents prepared. However, bills still need to be paid and life proceeds as usual. In order to protect your loved ones who may not be able to do for themselves the way they used to - or want to - it may be necessary to file for a guardianship of the person and/or the estate to protect their interests.     While we all want to get along with our relatives, sometimes we disagree on how best to decide what care they need. We may also disagree on who best to take care of them and where they should be living.   • Successfully defended Estate and Trust personal representative in fiduciary prosecution where estate and trust existed for several years; prepared formal accounting for both estates and settled prior to discovery order.

  • Successfully intervened in the Law Division to dismiss a complaint and Lis Pendens with prejudice regarding a sale contract client had entered using their Power of Attorney.

  • Successfully enforced client’s ownership rights by trial

  • Represented clients in multiple million-dollar residential and mixed-used transactions.

  • Defended beneficiary’s right in probate action to act as Co-Administrator and remain in possession of estate property.

  • Successfully negotiated workouts in sale of a condominium where total liability was in excess of 200% the contract price.

  • Handled assignment contracts.

  • Have worked with New Jersey’s UHOT program regarding oil tanks and soil remediation.
