In an action for Partition, even if your name is not on the deed, you may be entitled to your portion of the equity in a forced sale. Sometimes, you may even have the right to buy your partner’s share out and own the entire parcel yourself! New Jersey abolished the estate, or “death” tax, in 2018, but that does not mean an estate nor beneficiaries are subject to a tax. In fact, decedents predeceasing 2018 may still have to file an estate tax return. Beneficiaries who are not Class “A” also require the personal representative to file an Inheritance Tax Return with the Division of Taxation and the requisite taxes paid. If a “vulnerable adult” or other person has “incapacity,” it may be too late to have estate planning documents prepared. However, bills still need to be paid and life proceeds as usual.
