Child Support Judgment Search - New Jersey Probate and Estate Administration
This is a shorter discussion about an often neglected but important topic, child support judgment searches. Whenever someone wins an award of money from a court order or inherits from a probate estate, child support obligations must be determined.
Pursuant to New Jersey statute, personal representatives of probate estates must initiate a child support judgment search for certain beneficiaries of a probate estate. This search must be made against the beneficiary, so you should obtain important information in order to order the most accurate search. If a child support judgement is found, it is the executor or administrator’s responsibility to first notify the beneficiary and satisfy the judgment prior to distributing their share of the probate estate. I regularly conduct these searches when I represent executors and administrators of probate estates to both protect the estate fiduciary and the probate estate itself from judgments and liability.
