Estate Planning

Estate planning is the end-of-life preparation we reasonably dread. It is difficult to think of, consider, and come to terms with the fact we eventually all will pass. But, just because it is difficult doesn’t mean we shouldn’t face it and be ready. How will you prepare, and what are you supposed to do? Well, the best plan is the one that fits your needs. As an estate planning attorney, there are several tools we can discuss that may fit your estate plan. Remember, these tools typically only take effect (1) after your death, or (2) upon specific conditions that must be met.

The first step is figuring out exactly what you own: bank accounts, life insurance, pensions, real estate holdings, investments in stocks/bonds/CDs, cars, and so on. Next - and often forgotten by many people - you should pick a primary and alternate person to be responsible for carrying out the wishes you state in your will. Then, you should consider what you are ultimately looking to do with it - give it all to a family member, give something to charity, etc. After we discuss all of the above, I can strategize a plan with you to implement your wishes and flexibility (or lack thereof).

Estate planning tools include a myriad of documents and entities. Some of these include the following:

  • Last Will and Testament

  • Power of Attorney (General or Durable)

  • Advance Directive and Healthcare Proxy

  • Revocable and Irrevocable Trusts

  • LLCs

  • Quitclaim deeds

  • Life Estates
